IT - Solid Solutions Useragreement.
- General Definitions.
a. This agreement concerns all IT - Solid Solutions SolidWeb customers.
b. IT - Solid Solutions SolidWeb will hereafter be referred to
as 'the provider'.
c. IT - Solid Solutions SolidWeb customers will hereafter be referred
to as 'the customer'.
d. Other conditions may apply for promotions and/or specials.
- Objectives.
The purpose of the agreement is:
a. to guard 'the customer' against issues caused by other users.
b. to avoid misunderstandings between 'the provider' and 'the
customer'.
c. to point out what "the customer' is permitted by 'the
provider' on his hardware or other
infrastructure.
d. giving a legal certainty to 'the provider' and 'the customer'.
- Acceptable Use.
a. 'the customer' is forbidden to store, consult or use in any
other way, data that is found illegal
according to Belgian, Dutch or American
law.
b. 'the customer' can under no circumstances store copyrighted
data, unless they have explicit
written permission from the author or
other holders of the relevant copyright.
c. 'the customer' can not store, divert, distribute or download
pornographic material on his
account.
d. 'the customer' is nor permitted to use anything of 'the provider's
' infrastructure for Denial of
Service and/or Distributed Denial of Service
attacks. In addition this falls under the
computercrime law and can thus be prosecuted.
e. The infrastructure of 'the provider' may, in no way be used
to hack, deface or damage what so
ever to any other computer on the internet,
this directly and indirectly. This will also be
prosecuted.
f. 'the customer' will abide by the conditions enforced by 'the
provider' by means of further
conditions per account, of which the data
is found on the website http://www.solidweb.be .
In case of a so called 'Custom' package,
the conditions found in the confirmation-email apply.
g. 'the customer' is forbidden to overload a part of 'the provider's
' infrastructure
in any way or for any purpose. Overloading
consists of manipulating the infrastructure in a way
that it is no longer available in the
way 'the provider' determines it.
h. 'the customer' shall in no way what so ever give his password
or other means of access to
third parties, unless explicitly reported
to 'the provider' by means of e-mail to sales@it-ss.be.
Only with confirmation of 'the provider',
by means of e-mail, can 'the customer' provide access
to third parties. In this case 'the customer'
holds full responsibility for any actions of this third
party on his account/accounts, and the
conditions of this useragreement are still enforced.
i. 'the customer' is forbidden to send unwanted e-mail
to any which address. Unwanted e-mail
consists of, but is not limited to, sending
large numbers of e-mail for commercial purposes
('spamming'), the forging/modification
of e-mail headers.
This does not include a mailinglist, as
long as the addressee's have the possibility of being
removed from the mailinglist, and this
is clearly stated by 'the customer'. In case of doubt
about the clarity of this 'the provider'
can force 'the customer' to make adjustments in order
to clarify this. 'the provider' decides
when there's doubt.
- Other conditions.
a. 'the provider' can, without prior notice, terminate the account
or accounts of 'the customer',
and this without any form of refund in
any way. 'the customer' commits himself to accept this
condition and has no right to a compensation
in any way. In case of a dispute on the validity of
the possible reason for termination 'the
provider' always has the final word, and this is
irrevocable.
b. 'the provider' can not be held liable for damages run into
by 'the customer', either intellectually
or materially.
c. 'the customer' keeps the copyright of data stored on 'the provider's
' infrastructure when 'the
customer' holds the copyright of the data
in question.
d. However, 'the provider' has the right to inspect, store, save,
copy or any other
duplication/inspection of any data, including
that of item 4c. This right can only be used
concerning data that is in direct or indirect
violation of any article in this useragreement. This
also goes in case of doubt, in order to
gain certainty in certain cases. 'the customer' will not be
priory noticed in order to insure an independent
investigation. In case any data is in violation of
one or more articles of this useragreement,
the previously stated rights of 'the customer' are
no longer open and 'the provider' has
the right to release this data and 'the customer's'
personal data to the proper legal body's.
These body's can be, but are not limited to: lawyers,
federal police, public
e. In case of default of payment 'the provider' can remove 'the
customer's' account without prior
notice. Here to there can be no claim
for a compensation for 'the customer' in any way.
Furthermore 'the provider' has the right
to a proof of default of 'the customer' for the amount
of debt increased by 20% administration
fee's, starting from the amount of 200bfr
(or 4.96 euro).
f. 'the provider' holds the right to alter or modify this useragreement
at any thing for any reason,
and this without prior notice of 'the
customer'. 'the provider' will however do anything in his
power to notify 'the customer' as soon
as possible. 'the provider' can do this totally one-sided,
and takes effect on the moment of this
alteration. The applicable useragreement can be found
at http://www.solidweb.be and only the
Dutch version of this document is legally valid. Any
translation if only meant for clarification,
and can in no case be used as a legal document.
g. 'the customer' declares when ordering an account with 'the
provider' that he agrees to this
useragreement In case of a minor the parent(s)
or guardian(s) are responsible.
h. Any activity on 'the customer's' accounts are deemed his responsibility,
independent of who
does what with these account/accounts.
'the provider' therefor advises to use passwords with
a minimum of 8 letters/figures and preferably
a letter - figure combination with capital and
normal letters combined. However this
is no obligation 'the provider' will make the use of an
invalid password impossible.
